Johnson & Johnson Sued for its Vaginal Mesh Implant

(EMAILWIRE.COM, July 18, 2013 ) London, UK -- A Halifax woman has filed a $5 million lawsuit against Johnson & Johnson Inc. for alleged debilitating pain and extreme psychological stress after having a vaginal mesh implanted in 2008. Virginia Corkum received the Gynecare Tension Free Vaginal Tape-Obturator sling mesh to treat a bladder prolapse condition.

According to a statement of claim filed in the Nova Scotia Supreme Court in Halifax this week, Corkum alleges that she immediately experienced pain in her pelvic region as a result of the implanted mesh.

The suit was filed by Corkums lawyer, Paul Miller, who wrote in the suit that after the surgery, Corkum allegedly experienced trouble urinating, had to self-catheterize, cannot engage in sexual relations and has suffered from pain and recurring infections on an ongoing basis.

Corkum is also suing two companies in addition to Johnson & Johnson. One is a New Jersey subsidiary of Johnson & Johnson by the name of Ethicon Inc. The other is Gynecare Worldwide, which is a division of Ethicon. Both of these companies were part of the development and marketing processes for the mesh product.

Corkum alleges that her pain, additional surgeries, hospitalizations and permanent injuries occurred entirely as a result of the the defendants negligence.The suit stated that the defendants knew or should have known that the mesh could cause serious personal injury as it was made out of polypropylene, which is fabricated in part from waste petroleum byproducts and could, in turn, react adversely in the body. It further states that the three defendants did not engage in the necessary research and testing to determine if the mesh could be successfully implanted citing complications in initial studies before the product went to market.

Corkum is suing for $5 million in punitive, exemplary and aggravated damages, cost of insured health services provided by Nova Scotia, special damages, and court costs.
