Tapella & Eberspacher Remind Illinois Drivers of New Traffic and DUI Laws Commencing in 2014

(EMAILWIRE.COM, December 18, 2013 ) Charleston, IL Set to begin rolling out on January 1st, 2014, several new laws will impact cellphone use, drivers license acquirement, and driving under the influence penalties. The majority of the laws will be enforced on New Years Day while others go into effect throughout the rest of the year.

Beginning January 1st Illinois drivers will have to use a hands-free device, if a driver is caught using a handheld device they will be fined $75. Additionally, if a driver is caught using a mobile device during a car accident they will be charged with a Class A misdemeanor; if the accident is fatal it will be considered a class 4 felony.

However, drivers will be allowed to show proof of insurance using an electronic image on their mobile devices; many states are in the process of implanting such laws.

Drivers between the ages of 18 and 21 effective July 1st, 2014 will not be issued or allowed to renew a drivers license without successfully completing an adult driver education course. Furthermore, effective on New Years Day any person under the age of 18 who has a traffic citation for which a disposition has not been rendered may have their license cancelled.

The New Year also brings about the implementation of the Compassionate Use of Medical Cannabis Pilot Program Act which means that DUI provisions may not apply to the lawful consumption of cannabis by a qualifying patient in possession of a valid registry issued under the act. However, drivers will be required to consent to field sobriety tests as refusing to, or failing to, complete a test will net a 12-month suspension.

Separate offenses for exceeding the speed limit in a construction or maintenance zone when workers are and are not present will go into effect as well in 2014, however, both provide for minimum fines of $250.
